3. Orders and Payments

  • All orders are subject to availability and written confirmation.

  • Prices are provided in EURO and include VAT. Customs duties, import taxes, and shipping are excluded unless stated otherwise. 

  • Orders are processed only after full payment or according to the agreed invoice terms.

4. Shipping and Delivery

  • Shipping fees are shouldered by the buyer.

  • Delivery times are estimates and not guaranteed.

  • Risk transfers according to the agreed Incoterms (e.g., EXW, FOB, CIF, DAP).

  • Delays caused by logistics companies and other third-party carriers are beyond our control.

5. Food Safety & Compliance

5.1 Product Compliance

All food products are sourced from suppliers that operate under applicable food safety standards in their country of origin. However, the buyer is responsible for ensuring that the products comply with the import regulations, food safety laws, and labelling requirements of the destination country.

5.2 Certifications and Documentation

Where applicable, we may provide commercial invoices, packing lists, certificates of origin, or supplier-provided documentation. We do not guarantee acceptance by customs or food authorities.

5.3 Storage and Handling

Unless otherwise agreed in writing, 5085 Food Trading is not responsible for storage conditions after dispatch. Proper storage, transport, and handling after delivery are the buyer’s responsibility.

5.4 Allergens and Ingredients

Buyers must independently verify ingredient lists, allergen declarations, and suitability for their market. Product formulations and packaging may change without notice.

6. Customs, Duties, and Inspections

  • Customs duties, inspections, clearance fees, and delays are the responsibility of the buyer unless agreed otherwise in writing.

  • Refusals, seizures, or destruction of goods by authorities due to non-compliance are not grounds for refund.

7. Returns, Refunds, and Claims

  • Due to the nature of food products, returns are not accepted unless goods are proven defective, expired or non-conforming at delivery.

  • Claims must be submitted in writing within 48 hours of receipt with supporting evidence.

  • Approved refunds, if any, exclude shipping, handling, customs, and inspection costs.

8. Limitation of Liability

To the fullest extent permitted by law:

  • 5085 Food Trading is not liable for indirect or consequential losses, including regulatory penalties or lost profits.

  • Liability is limited to the value of the affected goods.

9. Intellectual Property

All website content, including text, images, and logos, is the property of 5085 Food Trading and may not be used without written permission.
